1. Introduction
Welcome to HostPrimeX ("we", "us", "our"). These Terms of Service ("Terms") govern your use of our web hosting services, domain registration services, and related products available through hostprimex.com. By using our services, you agree to these Terms in full.
2. Services
HostPrimeX provides shared web hosting, domain registration, SSL certificates, email hosting, and related internet services. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3. Account Registration
To use our services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years of age to register an account.
4. Payment Terms
All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Payment is due at the time of order placement. We accept payments via UPI, credit/debit cards, net banking, and digital wallets through our payment gateway partner Cashfree. Hosting accounts are provisioned automatically upon successful payment. Renewal invoices are generated 14 days before the due date. Failure to pay by the due date may result in service suspension.
5. Refund Policy
We offer a 30-day money-back guarantee on all new hosting plans. If you are not satisfied with our service within the first 30 days of purchase, you may request a full refund. Domain registrations, SSL certificates, and add-on services are non-refundable. Please refer to our separate Refund Policy page for complete details.
6. Acceptable Use
You agree not to use our services for: hosting or distributing illegal content, sending unsolicited bulk email (spam), hosting malware, phishing sites, or fraudulent content, mining cryptocurrency, running IRC bots or similar services, or any activity that violates applicable Indian or international laws. We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
7. Resource Usage
Shared hosting accounts are subject to fair usage limits. Excessive use of CPU, RAM, disk I/O, or bandwidth that negatively impacts other users on the server may result in temporary resource throttling or account suspension. We will notify you before taking action whenever possible.
8. Uptime Guarantee
We guarantee 99.9% network uptime on an annual basis. If we fail to meet this guarantee, you may be eligible for service credits as outlined in our Service Level Agreement (SLA). Scheduled maintenance windows are excluded from uptime calculations.
9. Data Backup
We perform daily automated backups of all hosting accounts as a courtesy service. However, you are ultimately responsible for maintaining your own backups. We are not liable for any data loss. We strongly recommend that you maintain independent backups of your website files and databases.
10. Domain Registration
Domain registrations are processed through our registrar partners. Domain registration fees are non-refundable. You are responsible for ensuring that your domain registration information is accurate and up-to-date. Domain transfers, renewals, and disputes are subject to the policies of the respective domain registrar and ICANN.
11. Account Termination
Either party may terminate the hosting agreement at any time. Upon termination, your data will be retained for 30 days, after which it will be permanently deleted. You are responsible for backing up your data before account termination.
12. Limitation of Liability
To the maximum extent permitted by law, HostPrimeX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our services. Our total liability for any claim shall not exceed the amount paid by you during the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless HostPrimeX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services or violation of these Terms.
14. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
15. Modifications
We may update these Terms from time to time. Material changes will be communicated via email or through our website. Continued use of our services after such changes constitutes acceptance of the modified Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Nagaon, Assam, India.
